COMICAL COURT CASE
OF THE MONTH

Illinois: Palmer House sued by man who says he tripped over luggage. A man is suing the Palmer House Hilton, claiming he suffered "great pain, anguish and suffering" after he tripped on an "unattended piece of luggage." Richard J. Wood says he was a guest at the Palmer House on Oct. 7, 2007 when he tripped over the luggage and fell. Wood contends the hotel had a duty to "maintain said hotel area in a safe condition, free of luggage left unattended."

I want to wish everyone a Happy New Year! As we proceed into 2010, it is so important to maintain perspective and keep in mind the quality of life you would like to have for yourself and your family. Obviously health, prosperity and happiness are high on everyone’s list, however in order to realize these goals, all of us should make sure our legal world is in order.

With 400,000 new laws having come into play as of January 1, 2010, along with approximately 1 million new state and federal regulations, I remain committed to keeping others informed of the current state of the law – and how it affects you and your family.

As most of you know, one of my passions is to help clients establish an effective Living Trust. The old theory that a Living Trust is for the rich has gone by the wayside. If you own Real Estate, OR you have assets approaching $100,000 OR you have family, you really should inquire how a Living Trust protects you and your family from government intrusion, financial disaster, and undue delays that can be devastating.

Going forward I will be producing our newsletter bi-monthly and will attempt to provide you with quality legal information that will be relevant to you, and provide legal entertainment to hopefully promote a chuckle as well.

New California Laws for 2010

Click here for more details regarding each of these newly-enacted laws below:

AB 14 - a motor vehicle can be decalred be a public nuisance and impounded for up to 30 days when the motor vehicle is used in the commission of specified crimes related to prostitution.

AB 58 - Now an Infraction to participate in a betting pool with less than $2,500 at stake.

AB 91 - a new "Ignition Interlock Device" Law requires first-time DUI offenders to install a device in their vehicles in a test program in Alameda, Los Angeles, Sacramento and Tulare counties.

AB 532 - will allow police to obtain a search warrant warrant to seize guns or other deadly weapons from within a house after a report of domestic violence or mental health incident.

SB 598 - will give a repeat DUI offender the opportunity to apply for a restricted driver license with an ignition interlock device placed on their vehicle.

AB 962 - requires gun sellers to record sales of ammunition, and requires the fingerprinting and identification of the purchaser.

FACTOID: The “no contest” clause cannot prohibit a prospective heir from contesting a trust if there is a reasonable belief that fraud, undue influence or duress was in existence to influence the execution of the trust
